UAE notice period questions answered

What is the notice period in UAE?

Under Federal Decree-Law No. 33 of 2021, the minimum notice period is 30 days for most employees. Contracts can specify up to 90 days. Neither party can waive the notice period without mutual agreement.

Can my employer make me leave immediately?

Your employer can ask you to leave immediately (garden leave) but must still pay you your salary for the full notice period. Paying in lieu of notice is allowed only by mutual agreement.

What happens if I do not serve my notice?

If you leave without serving the notice period, your employer may deduct an equivalent amount from your final settlement. They may also mark your employment record accordingly with MOHRE.

Is the probation period the same as the notice period?

No. During probation, the notice period is 14 days for the employee and 1 month if the employer terminates. The standard 30-day notice applies only after probation ends.

Do UAE notice period rules apply to free zone companies?

Mostly yes — UAE Federal Labour Law applies to most free zones except DIFC and ADGM, which have their own employment regulations.

What is the notice period for senior executives in UAE?

UAE law allows notice periods of up to 3 months (90 days) for senior roles. The exact period is determined by the employment contract, provided it is at least the 30-day minimum.

Can I take annual leave during my notice period?

Yes, you can use accrued annual leave during notice if your employer agrees. However, the employer may also require you to work through the notice period.

What is garden leave in UAE?

Garden leave means your employer releases you from attending work but continues to pay your salary during the notice period. You remain an employee during this time and cannot join a competitor if a non-compete clause applies.
