Under Federal Decree-Law No. 33 of 2021, gratuity is 21 days of basic salary for each year of the first 5 years, and 30 days of basic salary for each year beyond 5. The daily wage is your monthly basic salary divided by 30.
Yes. Under the new UAE Labour Law (effective 2022), employees who resign are entitled to full gratuity — there is no longer a deduction for resignation as there was under the old law.
You must have completed at least one full year of continuous service to be entitled to gratuity. Employees with less than 1 year of service receive no gratuity.
Gratuity in UAE is calculated on basic salary only, not on total package. Allowances such as housing, transport, and food allowances are excluded.
Total gratuity cannot exceed the equivalent of 2 years of total remuneration (full package, not just basic). In practice this cap is rarely reached.
If you are terminated (not for gross misconduct), you receive full gratuity calculated on the same basis as resignation. Termination for gross misconduct under Article 44 forfeits the right.
For most UAE residents, gratuity is not subject to income tax in the UAE. If you are an Indian national returning to India, the gratuity may be taxable in India beyond a threshold.
Gratuity is paid by your employer on your last working day or within 14 days of the end of contract. If not paid, you can file a complaint with the Ministry of Human Resources (MOHRE).
